Legal & Business Affairs Workshop for Producers and Creators

Iberseries & Platino Industria has opened the call for applications for The Clearance Process in Audiovisual Production. A Practical Legal & Business Affairs Workshop for Producers and Creators, an initiative designed to strengthen the legal expertise of audiovisual industry professionals in the prevention and management of legal risks throughout the production and exploitation of audiovisual works.vv

The workshop will provide a highly practical overview of the clearance process, covering key topics including intellectual property, personality rights, the identification of legal contingencies, and the tools available to minimise legal risks throughout the entire production lifecycle.

The programme will take place over three in-person sessions, from 29 September to 1 October, at Matadero Madrid, and will feature specialists in intellectual property, Legal & Business Affairs, audiovisual production and clearance from law firms, production companies, collective management organisations and other leading industry organisations.

Participants with experience or an interest in the legal aspects of audiovisual production will be selected. The workshop will be conducted entirely in Spanish.

To apply, participants must hold a valid Iberseries & Platino Industria accreditation at the time of registration and submit a motivation letter, curriculum vitae (CV), and a short biography.

Day 1

  • Introduction: What is clearance?Speaker: Ángela Estévez, lawyer in EGEDA’s Legal Department.
  • Intellectual and industrial property considerations. Key intellectual and industrial property issues and potential legal risks to be taken into account in an audiovisual production.

Speaker: Patricia Mariscal Garrido-Falla, Managing Partner of the Intellectual Property Department at Bardají & Honrado Abogados, PhD from the Autonomous University of Madrid.

  • Case study: Legal review of a screenplay.

Speaker: Alberto Adúriz Sarabia, Senior Lawyer in the Intellectual Property Department at Bardají & Honrado Abogados.

Day 2

  • Personality rights. Implications for documentary productions and fictional works based on or inspired by real events: potential issues relating to the rights to honour, personal and family privacy, and the right to one’s own image of real individuals that may arise in a project, with particular emphasis on documentaries and fictional works based on or inspired by real events, as well as risk mitigation tools.

  • How to structure a project’s clearance process: how to integrate the clearance process into the production workflow, including the roles involved, the stages at which it should be addressed, and the key aspects to consider.

Speaker: Pilar Perlado Hergueta, Clearance Coordinator and Co-Coordinator of the Master’s Degree in Clearance at the Madrid Film and Audiovisual School (ECAM).

Day 3

  • The value of clearance for the commercial exploitation of a work: the importance of clearance throughout the project’s subsequent exploitation chain (warranties, deliverables, E&O insurance, etc.).

Speaker: Jorge A. Sánchez Sánchez, Legal and Business Affairs Director at LAZONA, where he provides specialist advice on audiovisual production, intellectual property, clearance, contracting, financial structuring, and the exploitation of film and television works.

  • Success Story: “México 86” Roundtable: the professionals involved in the production will share their experience and discuss the legal challenges they faced in this project, inspired by the circumstances surrounding the organisation of the 1986 FIFA World Cup in Mexico.
